Terms of Service
1. Acceptance of Terms
By creating an account or using the Wet Paint application at getwetpaint.app ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms form a legally binding agreement between you and David Morgan, the operator of Wet Paint, an Australian sole trader. By clicking "Create Account" you confirm you are at least 18 years of age and have the legal capacity to enter into this agreement.
2. The Service
Wet Paint is a personal finance and budgeting application that allows you to:
- Create and manage an annual budget by category and line item
- Import bank transactions via CSV upload or Open Banking connection
- Track actual spending against your budget
- Monitor mortgage, investment, and wealth information you enter
- Use AI-assisted transaction categorisation (where enabled)
The Service is provided for personal, non-commercial use only. Wet Paint is a budgeting tool and does not constitute financial advice. See our Financial Disclaimer.
3. Your Account
3.1 Registration
You must provide a valid email address and a password of at least 12 characters to register. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
3.2 Email Verification
You must verify your email address before accessing the Service. A verification link will be sent to the address you provide at registration.
3.3 Account Security
You must notify us immediately at hello@getwetpaint.app if you become aware of any unauthorised access to your account. We recommend enabling two-factor authentication (TOTP) for additional security.
3.4 One Account Per Person
Each account is for use by a single individual. You may not share your account with, or transfer your account to, another person.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable Australian law
- Attempt to gain unauthorised access to any part of the Service, another user's account, or our infrastructure
- Upload malicious code, viruses, or any content designed to disrupt or damage the Service
- Scrape, crawl, or systematically extract data from the Service by automated means
- Misrepresent your identity or impersonate another person
- Use the Service in any way that could damage, disable, or impair the Service or its servers
- Attempt to reverse engineer, decompile, or disassemble any part of the Service
- Use the Service for commercial purposes, resale, or on behalf of third parties
5. Your Data
5.1 Ownership
You retain ownership of all financial data and content you enter into Wet Paint. We do not claim any intellectual property rights over your personal financial data.
5.2 Licence to Operate
By using the Service, you grant us a limited, non-exclusive licence to store, process, and display your data solely for the purpose of providing the Service to you.
5.3 Data Accuracy
You are responsible for the accuracy of data you enter into the Service. Wet Paint displays information based on what you provide and cannot verify its accuracy. We are not responsible for any decisions made on the basis of inaccurate data you have entered.
5.4 Data Export and Deletion
You may request a copy of your data or deletion of your account at any time by contacting us at hello@getwetpaint.app. See our Privacy Policy for details.
6. Intellectual Property
The Wet Paint application, including its design, features, branding, and code, is owned by David Morgan and is protected by Australian and international intellectual property laws. You may not copy, reproduce, modify, or create derivative works from any part of the Service without our express written permission.
7. Limitation of Liability
To the maximum extent permitted by law, Wet Paint and its operator are not liable for any:
- Loss of data or corruption of your financial records
- Financial decisions made on the basis of information displayed in the Service
- Indirect, incidental, special, or consequential losses arising from your use of the Service
- Service interruptions, outages, or downtime
- Errors, inaccuracies, or omissions in transaction data retrieved via Open Banking
- Security breaches caused by circumstances outside our reasonable control
Our total liability to you for any claim arising from your use of the Service is limited to the amount you have paid us in the 12 months preceding the claim (or AUD $100 if you have paid nothing).
8. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot lawfully be excluded or limited. This includes any consumer guarantees that may apply to the supply of the Service.
9. Termination
9.1 By You
You may stop using the Service at any time. To permanently delete your account, contact hello@getwetpaint.app.
9.2 By Us
We may suspend or terminate your account immediately if you breach these Terms, engage in conduct that we reasonably believe is harmful to other users or to the Service, or if we are required to do so by law. Where practicable, we will notify you before taking such action.
9.3 Effect of Termination
Upon termination, your right to access the Service ceases. We will delete your data in accordance with our Privacy Policy.
10. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
